SWARM BASEBALL RELEASE OF LIABILITY AND WAIVER FORM
✓ MANDATORY CONDITIONS OF PLAY
I agree to adhere to the following conditions in order for my son/daughter to participate in team activities including practice, games and events. Disregarding these conditions, may result in immediate dismissal from the event or the organization.
- If any player, parent, or family member has a fever, is feeling ill or showing any symptoms of Covid-19 (please see CDC guidelines for likely symptoms), he/she must stay home and have no contact with any player, coach or family member of the team.
- If any player, parent or family member has tested positive for Covid-19, he/she must alert the team manager immediately.
- Parents should practice social distance when attending practice. It is preferred that you drop your child off and pick him/her up at at the end of practice or wait in your car. Siblings are not allowed to attend organized practices.
- Parents are not allowed near or in the dugout unless asked by a coach or in an emergency situation.
- Players should be cognizant of social distance at practice and games. Walking to the field, warming up, sitting in the dugout, playing the game, packing up gear, walking to another field or leaving the park, are all situations that are appropriate times to practice social distance.
- Players may wear a ,mask if they choose and can do so without undue attention and ridicule. It is an individuals right to wear a mask and can do so at any time.
- Depending on the situation, players may now have direct contact before, during, or after practice and games including fist bumps, elbow bumps, chest bumps, high fives or other team appropriate celebration.
- As a general rule, players should not rub their eyes, touch their face, pick their nose or spit at any time. If they do, they should immediately wash their hands or use hand sanitizer.
- Players should sneeze into their jerseys if they are not wearing a mask. This is done by pulling out the neck, tilting the head down into the jersey, and holding the jersey above the neck. Player should stay in sneeze position for several seconds after sneezing has finished.
- Players should not borrow equipment or gear, nor should they share food, seeds, water or anything else at practice or games.
- Please do your best to practice proper hygeine and social distancing at pre and post game manager meetings.
- Players and coaches must follow all additional rules, stipulations and guidelines put forth by the tournament directors.
- The above Mandatory Conditions of Play are in addition to, not superceded by, additional requirements from city, state and tournament officials. Failure to meet the minimum standards above may result in the immediate termination of play.
✓ PARENTAL WAIVER
I hereby authorize managers, coaches, directors and associates of Swarm Baseball to provide baseball instruction to my child and understand that my participation at this time is completely voluntary. I understand that there will be no immediate, short or long term repurcussions or negative actions taken against my child in any way if I decide not to participate and, fully understanding the risk involved with participating at this time, have decided to let my son participate. Even though government officials and baseball tournament directors have allowed play to resume, I am fully aware of the risk of the Covid-19 virus and participate willingly and voluntarily and assume all risks of my decision to allow my son or daughter to play.
I know of no mental or physical problems which affect my child’s ability to safely participate in baseball at this time and pledge that my child does not currently have the Covid-19 virus or any symptoms of the virus. Undersigned hereby voluntary and forever releases, holds harmless, discharges, waives and relinquishes any and all actions, causes of action, or claims for personal injury, illness, including but not limited to Covid-19, or wrongful death occuring to his/her child, against Swarm Baseball Foundation, team managers, coaches, directors, affiliates, sponsors, et al. (“Releasees”) arising out of his/her participation in all baseball activities at this time. I hereby authorize managers, coaches, directors and associates of Swarm Baseball to act on my behalf according to their best judgment in any emergency requiring medical attention.
✓ PARENTAL RELEASE OF LIABILITY
In consideration of my minor child/ward {playerName} (“my child”) being allowed to participate in the Swarm Baseball Program, its related events and activities, I understand, acknowledge, appreciate and agree that:
- The risk of contracting the Covid-19 virus from the sports activities involved in this program is currently present due to the nature of the sport (s), and
- FOR MYSELF, SPOUSE AND CHILD, I KNOWINGLY AND FREELY ASSUME ALL RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my child’s participation, and:
- I willingly agree to comply with the program’s stated and customary terms and conditions for my child’s participation. If, however, I learn my child may have recently been exposed to the virus, or I observe any unusual concern in my child’s readiness for participation and/or in the program itself, I will remove my child from participation and bring such to the attention of the nearest official immediately, and;
- I, for myself, and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS THE ENTIRE SWARM BASEBALL FOUNDATION ORGANIZATION, AND ITS OFFICERS, DIRECTORS, OFFICIALS, AGENTS, OWNERS AND /OR EMPLOYEES, AND ALL SUBSIDIARIES, OTHER PARTICIPANTS, SPONSORING AGENCIES, SPONSORS, ADVERTISERS, AND, IF APPLICABLE, OWNERS AND LESSORS OF PREMISES USED FOR THE ACTIVITY, WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, INCLUDING BUT NOT LIMITED TO COVID-19, DISABILITY, DEATH OR LOSS OR DAMAGE TO PERSON OR PROPERTY, regarding my child and/or arising from his/her activities, WHETHER ARISING FROM NEGLIGENCE OF THE RELEASEES OR OTHERWISE, except for willful misconduct, or otherwise to the fullest extent of the law.
